Jerrold Nadler" width="180" height="100" />In an interview with <a href="http://dcagenda.com/2009/12/10/no-doma-repeal-next-year-nadler/" target="_blank">DC Agenda</a> (formerly the Washington Blade), Rep. Jerrold Nadler (D-NY) did not expect to take up his  &#8220;Respect for Marriage Act&#8221; until 2011, after other LGBT-focused legislation had been voted on, including the ENDA, DADT and UAFA.</p>
<blockquote><p>“The Respect for Marriage Act comes up after that, maybe at the end of the next Congress, maybe afterward,” he [Nadler] said.</p>
<p>Nadler’s legislation would overturn DOMA, allowing the federal government to recognize same-sex marriages. It also has a “certainty provision” that would allow same-sex couples to marry in one state and still receive federal benefits even if they move to another state where gay nuptials aren’t recognized.</p>
<p>In lieu of passage in this Congress, Nadler said the task for supporters is to find more co-sponsors for the bill. As of Tuesday, the bill had 105 co-sponsors. Nadler predicted support would grow.</p>
<p>“And I think if some of these other bills pass, it’ll become more — the idea becomes less avant garde,” he said.</p></blockquote>
<p>Nadler also introduced the Uniting American Families Act (UAFA) earlier this year, which would allow gays and lesbians to sponsor their foreign-born partners for citizenship, and is pushing for that legislation to be a part of larger immigration reform in 2010.</p>
<blockquote><p>“I don’t know what the final comprehensive immigration reform will look like, but I remain optimistic that it will include lesbian and gay families,” he said.</p>
<p>In the event that comprehensive immigration reform legislation doesn’t include UAFA when it debuts, Nadler said he’s working on making sure there are votes in the House Judiciary Committee to amend the bill to include such a provision.</p>
<p>Nadler said he’s “hopeful” there will be enough votes for an amendment, but added “that’ll be a big fight, if necessary.”</p>
<p>“I haven’t taken any votes or whip counts or done any kind of that work, but certainly it will be something that we’ll have to work at and the gay community and everybody will have to be pressuring the individual members of the committee,” Nadler said. “A lot of the members of the committee, the Democratic members especially, say they’re very great friends with the gay community … and this’ll be an opportunity to show that they are, bar none.”</p></blockquote>
<p>When asked if he would support immigration reform without a UAFA or similar provision, Nadler reponded “I hope it doesn’t come to that.”</p>

Rep. Speier is a staunch advocate for gay rights, supporting UAFA, ENDA and the repeal of DOMA and DADT. While some may wonder whether Rep. Speier was in on the &#8220;joke,&#8221; I suspect she was simply playing it straight. I&#8217;m so glad to have someone like her representing our district. Enjoy. </p>

<p>Nice try invalidating our march. Sure, we&#8217;re just like the fringe that believed women should have the right to vote. And the fringe that demanded civil rights for blacks.</p>

(And a note to our readers: The White House just included all of you in that loony &#8220;left fringe.&#8221;)</p>
<p>I wonder how the Human Rights Campaign is going to explain how the White House just knifed our community less than 24 hours after he went to their dinner and claimed he was our friend.</p></blockquote>

The White House is expected to announce today that President Obama will be <a href="http://thecaucus.blogs.nytimes.com/2009/10/05/obama-to-address-gay-rights-organization/" target="_blank">attending the annual HRC dinner</a> in Washington, DC on Saturday evening, the day prior to the National Equality March.</p>
<blockquote><p>Mr. Obama’s appearance on Saturday at the annual dinner for the Human Rights Campaign, a leading gay rights advocacy group, represents a significant show of support for gay rights at a time when many prominent gay and lesbian activists have been questioning the president’s commitment to their issues.</p>
<p>Many gay rights activists have become increasingly vocal about their frustration over what they see as tepid support from Mr. Obama. While the president has professed support for overturning the ban on gays in the military and called the law that precludes federal recognition of same-sex marriages discriminatory, he has not engaged on gay rights issues as actively as some had hoped.</p>
<p>The Justice Department is defending the federal marriage law, known as Defense of Marriage Act, much to the dismay of many gay rights advocates. And Mr. Obama has been noncommittal about when he will move to end the “don’t ask don’t tell” policy. In June, he acknowledged their irritations at the slow pace of change at a gathering of about 250 gay rights leaders who had been invited to the White House.</p>
<p>While it remains to be seen what Mr. Obama’s appearance at the dinner will do to his standing in the eyes of gay rights activists, his speech may mollify some of their concerns.</p>
<p>His appearance will mark only the second time a sitting president has spoken to the Human Rights Campaign. The first time was in 1997 when Bill Clinton spoke to the group. That was the first time a sitting president had ever addressed a gay rights organization.</p></blockquote>
<p>Here&#8217;s hoping the President will hang around and make an appearance at the Equality March on Sunday. But I wouldn&#8217;t count on it, despite this <a href="http://www.inlookout.com/2009/09/28/cleve-jones-invites-obama-to-stand-with-us-at-national-equality-march/">warmly worded invitation</a>.</p>

<p>“Our bill ensures that all married couples, including lawfully married same-sex couples, will have the same access to federal responsibilities and benefits, including critical programs like Social Security that are intended to ensure the stability and security of American families,” Nadler said.</p>
<p>The repeal legislation would only facilitate federal recognition of same-sex marriages — not civil unions or domestic partnerships. Additionally, the bill contains a “certainty provision” allowing married same-sex couples to receive the federal benefits of marriage even if they move to a state that doesn’t recognize their union.</p>
<p>Nadler said the task ahead in trying to overturn DOMA “is not easy” and that he expects opponents of repeal to try to keep DOMA on the books by “making false claims that our bill will force same-sex marriage on unwilling states.”</p></blockquote>
<p>The bill has already garnered 90 co-sponsors, including Reps. Tammy Baldwin (D-Wis.) and Jared Polis (D-Colo). Noticeably absent from the list is Rep. Barney Frank (D-MA), who believes the bill is <a href="http://www.edgeboston.com/index.php?ch=news&amp;sc=&amp;sc2=news&amp;sc3=&amp;id=96326" target="_blank">not achievable in the short term</a>.</p>

			<content:encoded><![CDATA[<p><img class="alignright size-full wp-image-6830" title="Uniting American Families Act" src="http://www.inlookout.com/media/images/2009/08/uafaca.jpg" alt="Uniting American Families Act" width="180" height="100" />The California Assembly held a hearing today on resolution ARJ 15 which urges Congress and the President to pass the Uniting American Families Act (UAFA), which would allow gays and lesbians to sponsor their foreign-born partners, providing a legal path to citizenship. The bill, authored Assembly Member Kevin de León (D-Los Angeles), in part says:</p>
<blockquote><p>This resolution urges Congress to support the removal of legal barriers to immigration that affect permanent same-sex partners in binational relationships.  Specifically, the resolution calls on Congress either to include the Reuniting Families Act, which incorporates the Uniting American Families Act, in comprehensive immigration reform, or to pass the Uniting American Families Act on its own as stand-alone legislation.  In support of the measure, the author writes:</p>
<blockquote><p>The federal Uniting American Families Act (UAFA) would amend the Immigration and Nationality Act to add same-sex &#8220;permanent partners&#8221; to the list of family members that a U.S. citizen or legal resident could sponsor for immigration.</p>
<p>Since current law does not allow gay and lesbian Americans and permanent residents to sponsor their foreign-born partners for legal residency, they cannot access the family immigration system for green cards and immigrant visas.  Because of this inequity, thousands of lesbian and gay bi-national couples are kept apart, torn apart, or forced to stay together illegally, with one partner living in constant fear of deportation.</p></blockquote>

<p>ARJ 15 is co-sponsored by <a title="Equality California" rel="wikipedia" href="http://www.eqca.org" target="_blank">Equality California</a> (EQCA) and <a href="http://aacre.org/main/" target="_blank">Asian Americans for Civil Rights and Equality</a> (AACRE). <a href="http://oblogdeeoblogda.wordpress.com/about/" target="_blank">Melanie Nathan</a>, human rights attorney, Amos Lim, co-founder of <a href="http://out4immigration.org/immigration/homepage.html?=" target="_blank">Out4Immigration</a>, Gina Caprio who is unable to sponsor her British partner, and representatives from EQCA and AACRE will be providing testimony.</p>
<p>The bill is opposed by <a href="http://www.capitolresource.org/" target="_blank">Capital Resource Family Impact</a>, which believes UAFA undermines the Defense of Marriage Act (DOMA).</p>

<blockquote><p>“In a high-profile interview with Rick Warren, Barack Obama convinced millions of Americans he opposed gay marriage; we are calling on the President to live up to his campaign commitment” said Brian Brown [NOM Executive Director].</p>
<p>The National Organization for Marriage (NOM) announces today that their 2 Million for Marriage campaign now has topped 500,000 active supporters, part of a planned expansion of its activist base in preparation for fighting to prevent President Obama from overturning DOMA.</p>
<p>“NOM’s activist base is exploding, increasing tenfold in the first five months of this year,” said Brian Brown, “We’ve moved from 50,000 to more than 500,000 Americans pledging to protect DOMA.”</p>
<p>NOM’s goal for 2009 is to build an army of 2 million Americans willing to fight against efforts to repeal the Defense of Marriage Act. “At this rapid rate of growth, we will meet or exceed our ambitious goals by the end of 2009,” notes Brown.</p>
<p>“The National Organization for Marriage has emerged as the nation’s only major national grassroots organization dedicated to protecting marriage,” notes Maggie Gallagher, president and founder of NOM. “DOMA is the only federal law that protects marriage as the union of husband and wife, and guarantees voters in Georgia or Wisconsin that a handful of judges in Massachusetts will not be able to impose gay marriage on their state.”</p></blockquote>

			<content:encoded><![CDATA[<p><img class="alignright size-full wp-image-6773" title="Department of Justice" src="http://www.inlookout.com/media/images/2009/08/doj.jpg" alt="Department of Justice" width="180" height="100" />The Department of Justice has <a href="http://news.yahoo.com/s/ap/20090817/ap_on_go_ca_st_pe/us_gay_marriage" target="_blank">filed a new DOMA brief</a> in Federal Court today that softens the anti-gay rhetoric but still defends the law while it remains on the books.</p>
<blockquote><p><span id="lw_1250528172_0" class="yshortcuts">Justice Department lawyers</span> are seeking to dismiss a suit brought by a gay California couple challenging the 1996 <span id="lw_1250528172_1" class="yshortcuts">Defense of Marriage Act</span>. The administration&#8217;s response to the case has angered gay activists who see it as backtracking on campaign promises made by Barack Obama last year.</p>
<p>In court papers, the administration said it supports repeal of the law.</p>
<p>Yet the same filing says the <span id="lw_1250528172_2" class="yshortcuts">Justice Department</span> will defend the statute in this case because a reasonable argument can be made that the law is constitutional.</p>
<p>&#8230;</p>
<p>&#8220;The administration believes the Defense of Marriage Act is discriminatory and should be repealed,&#8221; said <span id="lw_1250528172_4" class="yshortcuts">Justice Department spokeswoman</span> Tracy Schmaler, because it prevents equal rights and benefits.</p>
<p>The department is obligated &#8220;to defend federal statutes when they are challenged in court. The Justice Department cannot pick and choose which <span id="lw_1250528172_5" class="yshortcuts">federal laws</span> it will defend based on any one administration&#8217;s policy preferences,&#8221; Schmaler added.</p></blockquote>
<p>A <a href="http://www.inlookout.com/2009/06/12/doj-motion-cites-incest-underage-marriage-to-dismiss-doma-challenge/" target="_self">previous filing in June</a> sparked outrage in the LGBT community for citing incest and underage marriage in defense of DOMA.</p>

			<content:encoded><![CDATA[<p><img class="alignright size-full wp-image-6314" title="Senator Claire McCaskill" src="http://www.inlookout.com/media/images/2009/07/mccaskill.jpg" alt="Senator Claire McCaskill" width="180" height="100" />Senator Claire McCaskill <a href="http://www.missourinet.com/gestalt/go.cfm?objectid=A39175B5-5056-B82A-37FD2022B5878C0C" target="_blank">suggested yesterday</a> if a concealed weapons law she had voted against had actually passed, it could have set a precedent for forcing states, like her home state of Missouri, to recognize another state&#8217;s gay marriage laws.</p>
<blockquote><p>Sen. McCaskill says she was not against letting people carry concealed weapons. But she is against requiring one state to accept another state&#8217;s laws that might differ from its own. She says it would be a foot in the door that could allow Vermont&#8217;s laws on gay marriage to be enforced in Missouri, which has a constitutional provision against gay marriage.</p>
<p>McCaskill says many of the supporters of the proposal are advocates for states&#8217; rights, but they want to override states&#8217; rights on carrying concealed weapons.</p></blockquote>

<blockquote><p>“In talking about my recent vote against the gun provision offered in the Senate, I wasn’t clear when I stated that my vote against that provision was because it came down to a states’ rights. I was expressing my frustration in that some who argue that states shouldn’t respect the laws, certificates, or permits from other states when it’s convenient, like with gay marriage, but then argue that they should when it’s convenient on another issue, like gun rights. They can’t have it both ways,” McCaskill said.</p></blockquote>
<p>While it is true that Republicans are demonstrating hypocrisy with regards to state&#8217;s rights on this issue, based on McCaskill&#8217;s original statement, it really sounds like she thinks DOMA is a &#8220;good&#8221; idea.</p>
<p><a href="http://promoonline.org/" target="_blank">PROMO</a>, The Missouri LGBT advocacy group has responded to McCaskill&#8217;s comments today:</p>
<blockquote><p>In a statement defending her opposition to this bill, she [McCaskill] stated: &#8220;This is a foot in the door that would require, for example, the laws in Vermont on gay marriage to be enforced in Missouri.&#8221;</p>
<p>This is a problem. A state&#8217;s rights argument is valid in this situation, however it is inconceivable that an ally can support Hate Crimes legislation- which recognizes the LGBT community is a target of increased abuse, intolerance and aggressive force- but uses a touchstone issue for the community as a shield rather than stand alone on an anti-gun sentiment.</p>
<p>In a time when we have seen incredible strides on a state by state basis, we have turned a corner and will not tolerate being used as a shield. Please reach out to Sen. McCaskill&#8217;s office and let her know while she is an ally, you won&#8217;t tolerate being used as a shield. The numbers listed are below for local and DC offices.</p></blockquote>
<p>Gay Republicans have also expressed <a href="http://www.gaypatriot.net/2009/07/23/sen-mccaskill-employs-anti-gay-scare-tactics-in-gun-debate/" target="_blank">particular outrage</a> over McCaskill&#8217;s comments, an outrage likely fueled more by the fact that McCaskill is a Democrat and their strong support of the concealed weapons law, than anything about gay marriage.</p>
